How to Purchase Property in Bulgaria

The purchasing process starts with contacting us about the reservation of a property/land.  As it is difficult to visualise properties from brochures or our website, at some point you will want to visit Bulgaria.  We shall be delighted to help you arrange an inspection trip.  Note that once you have chosen a property, you have to determine whether the sale includes the land or not, because according to the Bulgarian Constitution and legislation foreigners as persons can acquire only buildings but not land.  Only Bulgarian citizens and legal persons (including such with a foreign owner) can obtain the ownership of Bulgarian land.

How will this affect you?

As far as houses, villas, flats and limited ownership rights (the right to use, build a house, etc.) are concerned,you can directly purchase them as a person.  To buy a real estate property together with the land on the territory of Bulgaria you have to set up a commercial company.  That is a fairly straightforward process taking about four weeks.  Of course, there are other ways e.g.

  • Establishing a joint venture with existing local companies
  • Setting up a new venture
  • Acquiring a company through privatisation
  • Making a portfolio investment
Upon receipt of an initial contract of sale (similar to ‘Sold subject to contract’ in the UK), following the standard checks on the property made using a reputable Bulgarian solicitor you sign the Notary Act (contract of purchase) in front of a Bulgarian Notary either in Bulgaria, or at the Bulgarian Embassy in London.  Please, note that the final Notary Act is not signed until the building is completed in the case of off plan developments.

We strongly advise against independently buying an investment property or holiday home in Bulgaria as it is a testing experience, time consuming and problematic .  Apart from language difficulties (the alphabet is Cyrillic), the bureaucracy is daunting for the uninitiated.  There are also considerable risks.  Without proper support you could be charged inflated prices and there is the possibility of losing your deposit or indeed the full settlement amount due to credit settlement risk or legal risk.  (Credit settlement risk means that you pay for the property and do not receive the Title Deeds.  Legal risk means you buy the property from someone who is not the rightful owner.)  'Buy There' provide a service that is far more encompassing than a usual estate agency service while remaining extremely competitive.
